A 67 year-old woman has sued her nursing home and its owner after she says she was sexually assaulted in 2009.
The resident, who suffers from expressive aphasia, a condition that limits her ability to communicate, claims that the facility acted negligently in hiring the man. After a two-day trial, a jury found the 50 year-old employee not guilty of sexual assault. Her lawyer asserts that his focus is on the facility’s accountability and claims the exoneration does not prove it did not act improperly.
Both the owner and the nursing home face a total of eight charges, each being charged with violating the Consumer Protection Act and state regulations, negligence, and breach of contract.
