California resident Emma Thayer, a minor, is suing the automobile manufacturer Subaru for the wrongful death of her mother, Lisa Ann Thayer.
Both mother and daughter were driving down I-40 in California in a Subaru Forester when the vehicle experienced a rollover accident, during which Lisa Ann Thayer, who was properly restrained, was ejected from the vehicle and sustained fatal wounds. Emma Thayer, who also suffered injuries from the accident, survived the crash.
Additionally, Emma Thayer is suing for compensation of her own medical expenses, loss of past and future earnings and earning capacity, and general damages including personal injuries, pain and suffering, and legal costs (along with the aforementioned wrongful death suit).
Court documents state that the Subaru Forester Thayer was driving had manufacturing defects, namely an “unsafe restraint system and insufficient lateral and roll stability”.
