Wisconsin teenager gets probation for assault
Posted on Wednesday, September 7th, 2011 at 9:11 am
A Wisconsin teenager was given two years probation after he was accused of sodomizing a male student at the University of Wisconsin-La Crosse. The 19 year-old pled no contest last week to first-degree sexual assault charges. The judge did not give him jail time because the assailant was remorseful and apologetic and believes he acted out of character.
The teen's probation includes six months of electronic monitoring, counseling, mediation, and restitution along with six months in a county jail with work release. He must also stay out trouble for two years, write a letter of apology to the victim, and complete 80 hours of community service to have the sexual assault charges dropped. The man, however, was charged with misdemeanor battery and false imprisonment. Both students have since voluntarily left the university.

Feds investigate California plane crash
Posted on Wednesday, August 31st, 2011 at 8:44 am
A Cessna 172 aircraft crashed into a residential neighborhood in Santa Monica this Monday. The student pilot hit a cinder brick wall and the nose of the plane crashed into part of the house. The director of the Santa Monica Airport says the man was practicing his take offs and landings when the accident occurred. Fortunately, the pilot only suffered a broken leg and no one on the ground was injured. Three workers painting the home helped him out of the plane and put out a small fire with a garden hose.
Federal investigators are looking into the cause of the crash. The plane has been taken in to be examined for defects and investigators are conducting interviews with airport tower witnesses and the pilot's aviation school operators. Residents in the area have fought to ban fast-landing jets but were shot down by the FAA.

Nursing home to appeal $91.5 mil lawsuit
Posted on Wednesday, August 24th, 2011 at 4:14 am
A West Virginia jury found a nursing home guilty of neglect and awarded the victim's family with $91.5 million. The family's 87 year-old grandmother died in nursing home care after they claim the facility failed to provide the woman with enough food and water for three weeks.
Now the nursing home plans to appeal the decision to West Virginia's Supreme Court. They argue that the amount awarded violates the state's medical malpractice cap, but the defendants claim that since the elderly woman's death did not result from improper medicinal care, but nutrition and hydration neglect, that the medical malpractice cap law does not apply to this case. The family's lawyers also argue that the caregivers at the nursing home are not licensed to administer medicine, therefore medical negligence also did not occur. They hope the Supreme Court agrees and throws out the appeal.

Family awarded millions in birth injury lawsuit
Posted on Friday, August 5th, 2011 at 2:49 am
An Atlanta jury recently awarded a family millions of dollars in a birth injury lawsuit. The jury found the family's daughter developed cerebral palsy due to the negligence of the doctor.
The mother agreed to her doctor's suggestion at an induced labor because of the child's low heart rate. The doctor told her that he would induce labor and deliver the baby via C-section. However, after he induced labor he decided to deliver the baby naturally. This caused oxygen to be blocked to the brain, causing cerebral palsy.
