Wis. Protects Dog Bite Victims

It is the policy of Wisconsin’s justice to protect the public from dog attacks.  This policy was recently reinforced as the Wisconsin Court of Appeals ruled that a homeowner who shelters, protects, or feeds a dog, even though the dog is owned by another, is liable for personal injury caused when the dog runs out of the house and attacks a passerby.

The case arose after a dog escaped the home of someone other than its owner and attacked a neighbor.  The dog had been living at the residence with its owner for several months at the time of the attack. By the time the victim filed suit, the dog’s owner could not be located so the claim proceeded against the home owner and her insurance.

The court ruled that the woman and her insurance carrier were strictly liable due to the homeowner’s authority to protect third parties from the dog she had custody of or a relationship with the individual who had custody of the dog.

Car Accident in Newton: Driver Dies

These past few weeks have been full of winter weather, accidents, and tragic deaths.  In Wisconsin we are not strangers with the dangers of winter or what she brings to our Northern state.

However, tragedy truck Newton last week, on December 7th, in a two car collision on Wisconsin 42.  One of the victims of the car accident was twenty-year-old man who lost control of his vehicle. He crossed the center line and an SUV hit him head on, killing the man at the scene.

The people in the SUV were all taken to the Holy Family Memorial Medical Center to check for injuries.  However, none of them had any serious medical conditions and were relased later that day.

Medical Malpractice Case Put On Hold

 In California, a county judge has decided to put a $1.6 settlement medical malpractice case on hold.  The case involves a 24 year old woman who was paralyzed by the County Harbor-UCLA Medical Center, while she was undergoing back surgery.

The case was brought forth in 2005, and has been under settlement negotiations ever since.  $1.5 million dollars is at state for the county, along with another million from the hospital that did the surgery.   

They have scheduled the next hearing for December 5th to discuss where the case is going, whether a settlement is possible or if the girl decides to take the county to court.
