Recall on Harry Potter Bookends

Approximately 36,000 bookends shaped like characters from the Harry Potter series were voluntarily recalled today. The reason cited was unsafe amounts of lead in the paint, violating federal lead paint standards.

These bookends were sold between June 2004 and January 2006 at elementary school fund raisers, dollar stores, and other discount stores. They should be immediately returned to Giftco Inc. for a full refund.

California Minor Sues Subaru

California resident Emma Thayer, a minor, is suing the automobile manufacturer Subaru for the wrongful death of her mother, Lisa Ann Thayer.

Both mother and daughter were driving down I-40 in California in a Subaru Forester when the vehicle experienced a rollover accident, during which Lisa Ann Thayer, who was properly restrained, was ejected from the vehicle and sustained fatal wounds.  Emma Thayer, who also suffered injuries from the accident, survived the crash.

Additionally, Emma Thayer is suing for compensation of her own medical expenses, loss of past and future earnings and earning capacity, and general damages including personal injuries, pain and suffering, and legal costs (along with the aforementioned wrongful death suit).

Court documents state that the Subaru Forester Thayer was driving had manufacturing defects, namely an “unsafe restraint system and insufficient lateral and roll stability”.

School Bus Accident on First Day of School

For some students of Lincoln County in West Virginia, the first day of school did not go as smoothly as they might have hoped.

Superintendent David L. Roach reported that a school bus carrying children home after their first day of school was involved in an accident on Limestone Road in Hamlin, WV.  Luckily, although children were on the bus at the time of the accident, none of them were injured.

Roach reported that the driver of the bus at the time of the accident was actually a substitute bus driver.  He further reported that the driver is being tested for drugs—which the superintendent states is required anytime a school bus accident occurs.

The accident occurred between the school bus driver and Lewis Smith, who was driving a 1998 Mercury Sable.  According to Smith, there was some “miscommunication” between himself and the bus driver, resulting in the collision.
