$24 Million Awarded in Railroad Accident

Posted on Wednesday, June 18th, 2008 at 8:06 am

A jury blamed a railroad in the death of 4 people this week and awarded the families of the victims $24 million. The young victims riding in a Chevy Cavalier were between 17 and 20 in age. The railroad company, Burlington-Northern Santa Fe Railroad argued the victims in the vehicle were attempting to beat the train traveling at 60 mph when the crash occurred.

However, the jury agreed with prosecution in that the accident occurred because the railroad crossing warning signals failed to adequately warn the travelers of the train. The railroad company was found to be 90% responsible in the deaths.

Rottier Client Is Awarded 10 Million in Personal Injury Case

Posted on Friday, June 13th, 2008 at 5:06 am

A Mosinee man was awarded over 10 million dollars in damages last week for injuries he suffered from a faulty hospital procedure. Half of the award was for Larry Schultz’s pain and suffering.

Schultz was a nuclear pharmacist who had been diagnosed with multiple scolerosis. He sought treatment at St. Luke’s Medical Center in 2006. A drug was supposed to be injected into his spine which would relieve the spasticity caused by the illness. A medical resident injected Baclofen to reduce the effects of the disease as well as Reno-60 to trace the Baclofen. However, the Reno-60 was labeled not to be used as an intrathecal injection, meaning not to be injected into the spine.

Injuries from the mistake included severe spasiticity, neurological damage, and seizures. In addition, it resulted in the fracture of three vertebrae and his hips, an extremely painful condition which required surgery the use of a wheelchair.

Schultz was represented by Daniel Rottier. If you have been injured, please contact the a Stevens Point Personal Injury Lawyer at the law offices of Habush Habush & Rottier S.C. ® at 715-345-0004 today.

Crane Crash in NYC

Posted on Tuesday, June 3rd, 2008 at 3:06 am

On May 31st, a crane collapsed at a construction site in New York City. The crash killed two construction workers. This is the second crane to collapse in Manhattan in 2 months.

The city has confirmed the construction site violated several zoning regulations. Due to heavy criticism, the city’s building commisioner, Patricia J Lancaster, has resigned.

Investigators are focusing on a particular weld that failed as well as examining the crane model, Kodiak. Although Kodiak is no longer manufactured, there are four other working Kodiak cranes in the city. All construction work with cranes in the city was halted and will resume on June 2nd.
