School District Sued for Negligence in Boy’s Injury

A student and his mother are suing the Tuscon Unified School District (TUSD), alleging that its negligence allowed the boy to be attacked and injured by a classmate.

10-year-old Cody Barber was playing during P.E. class when he was knocked to the ground and kicked by another student, whose identity was not released. Cody suffered a severely lacerated spleen and was hospitalized for 6 days. According to the lawsuit, the school district was negligent because it allowed the attacker, a boy with a history of behavioral problems, to participate in activities that he was not supposed to.

No criminal charges have been filed against Cody’s attacker.

Rhode Island Supreme Court to Hear Lead Paint Case

The Rhode Island Supreme Court is scheduled to hear a case against three companies which once manufactured lead-based paint. The state filed suit against Sherwin-Williams, Millenium Holdings LLC, and NL Industries, Inc. nearly a decade ago, attempting to force the three companies to fund a multi-billion dollar remediation effort against harmful lead paint in many older homes and neighborhoods.

The suit, filed under a legal theory known as “public nuisance,” is one of only a few of its kind in the country. Similar lawsuits against the lead paint industry in the have been unsuccessful.

Woman Files Lawsuit Against Taxi Driver Convicted of Assault

A woman who was attacked by a taxi driver in 2004 has filed a personal injury lawsuit against him and his former employer, seeking compensation for physical and emotional injuries she suffered during the attack.

Cory Daniel Smith, the taxi driver allegedly pulled a knife on Jessica Matson and tried to forcibly drag her into his taxi. Though Smith argued at trial that he acted only in self-defense and that Matson was the aggressor, he was convicted and is currently serving 10 years in prison in connection with the incident.

Matson is seeking over $50,000 in damages from both Smith and Lucky 7 Taxi Service, claiming that taxi company was negligent in failing to adequately investigate Smith’s background and competence to operate a motor vehicle.
