Malpractice Lawsuit Filed in Case of Toddler Incorrectly Declared Dead

A malpractice lawsuit has been filed by the family of an Orange County, California toddler against the doctor and hospital which allegedly declared her dead – incorrectly.

Mackayla Jespersen was less than 2 years old when she fell into a swimming pool in November 2003. She was declared dead by doctors at Anaheim Memorial Medical Center and had her breathing tube removed. It was not until an hour later that a police investigator noticed the doctors’ mistake and alerted medical personnel.

The lawsuit alleges that Mackayla suffered permanent brain damage as a result of the episode and seeks punitive damages against Anaheim Memorial and Dr. Richard Oxman.

$30 Million Awarded in C-Section Birth Malpractice Suit

A $30 million judgment was handed down earlier this month by jurors in a medical malpractice suit in Florida. Jurors decided that the family of Jacob Tomlian was entitled to the compensation for injuries Tomlian sustained due to Westside Regional Medical Center’s delay in administering a Caesarean section. According to the suit, Dr. Mark Grenitz ought to have performed the C-section procedure earlier, after signs of fetal distress showed on the heart monitor.

Today, Tomlian is 16, suffering from cerebral palsy, severe mental retardation, and partial deafness.
