Strict Liability
Strict liability is a legal standard often applied in defective product liability cases. In simple terms, strict liability states that the manufacturer is responsible for any defects in the product, whether or not they exercised sufficient care in their manufacturing process. In other words, strict liability can assign responsibility without any proof of fault.
Strict liability is a much more stringent and demanding standard than negligence. While the negligence standard requires a victim to prove duty, breach of duty, and direct causation in order to prove another party responsible, strict liability ignores these requirements. Furthermore, the strict liability standard often ignores misuse on the part of the victim. In essence, strict liability holds that a manufacturer ought to foresee any reasonable chance of misuse and design their products to prevent any injury from occurring.
Because strict liability places such a heavy burden of responsibility on the manufacturer, plaintiffs have their burden of proof lightened. Instead of dealing with the multiple components of a negligence claim, plaintiffs dealing with strict liability usually need only show that a product was defective and link the defect back to the defendant.
